2. General Provisions

These Terms of Service govern the use of the Izbaviz online service, available at izbaviz.com and app.izbaviz.com (hereinafter: the “Service”).

By using the Service, you agree to these Terms of Service and the Privacy Policy.

The Service is intended for users aged 16 and over. Users under 18 should use the Service with the consent of a parent or legal guardian.

3. Type and Scope of Services

The Service provides AI-powered interior visualization services. Available tools include:

  • Room redesign — transform the look of a room into one of over 20 design styles for 12 room types.
  • Furnishing empty rooms — virtually furnish empty interiors with furniture and decor using 8 commercial presets.
  • Decluttering — digitally remove unwanted items from interiors at 4 intensity levels.
  • Mood and lighting change — modify the atmosphere of a room with 8 moods and 4 lighting options.
  • Wall repainting — virtually change wall colors with 12 predefined colors.

All tools also allow entering custom, personalized instructions.

4. Registration and User Account

Access to the full functionality of the Service requires creating a user account. Registration is available via email or through Google and Facebook accounts.

Users are required to provide truthful and up-to-date information during registration.

Users are responsible for maintaining the confidentiality of their login credentials.

Accounts inactive for more than 90 days may be automatically deleted. Before deletion, the user will be notified by email with 14 days advance notice.

5. Contract Formation and Pricing

The contract for the provision of electronic services is concluded upon creation of an account in the Service.

Using the visualization tools requires credits. Credit package prices are displayed in:

  • US dollars (USD), euros (EUR), or British pounds (GBP) — for users accessing the Service via izbaviz.com.
  • Polish zloty (PLN) — for users accessing the Service via izbaviz.pl.

All prices displayed in the Service are gross prices (inclusive of applicable taxes).

Current credit package prices are available on the Pricing page of the Service.

6. Payments

Payments for credit packages are processed through the following operators:

  • Stripe — for international users. Supported methods: credit and debit cards (Visa, Mastercard, American Express), Google Pay, Apple Pay.
  • PayNow (mBank S.A.) — for Polish-speaking users. Supported methods: bank transfers, BLIK, payment cards (Visa, Mastercard).
  • PayPal — available as an alternative payment method.

Credits are added to the user account immediately upon payment confirmation by the payment operator.

7. Credits

Credits are the internal currency of the Service enabling the use of visualization tools.

The cost of a single visualization depends on the selected quality:

  • Standard — 1 credit.
  • Pro 2K — 4 credits.
  • Ultra 4K — 8 credits.

Credits cannot be exchanged for monetary value. Purchased credits do not expire as long as the user account remains active.

In the event of account deletion, unused credits are forfeited.

8. Nature of AI Technology

The user acknowledges that:

  • Visualizations are generated by artificial intelligence models that operate probabilistically — results may vary with each run, even with identical settings.
  • The Controller does not guarantee that the visualization result will fully match the user expectations.
  • Generated visualizations are illustrative in nature and do not constitute professional architectural or construction designs.
  • AI technology is continuously evolving, and the quality of results may change as models are updated.

9. Right of Withdrawal

In accordance with applicable consumer protection laws, consumers have the right to withdraw from a distance contract within 14 days without giving a reason.

However, pursuant to applicable EU consumer law (Directive 2011/83/EU, Art. 16(m)), the right of withdrawal does not apply to the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer express prior consent and acknowledgment of the loss of the right of withdrawal.

Using purchased credits (generating the first visualization) constitutes express consent to begin performance and loss of the right of withdrawal with respect to the used credits.

For unused credits, the user may request a proportional refund within 14 days of purchase.

10. Complaints

Complaints regarding the operation of the Service may be submitted by email to: support@izbaviz.com.

A complaint should include:

  • The email address associated with the user account.
  • A description of the issue or concern.
  • The desired resolution.

The Controller will process complaints within 14 days of receipt. The user will be notified of the outcome by email.

11. Prohibited Content

It is prohibited to upload to the Service any content that is:

  • Illegal, including content that infringes the copyrights of third parties.
  • Pornographic, obscene, or depicting nudity.
  • Promoting violence, hatred, or discrimination.
  • Containing personal data of third parties without their consent.
  • Unrelated to the purpose of the Service (interior visualization).

The system applies automatic content moderation. Photos violating the above rules may be automatically rejected.

In case of repeated violations, the Controller reserves the right to suspend or permanently delete the user account after the third violation (three-strike policy).

12. Data Deletion

Uploaded photos and generated visualizations are automatically deleted from the Service servers after the following periods:

  • 7 days — for free accounts.
  • 30 days — for basic accounts.
  • 90 days — for premium accounts.

Users may delete their photos and visualizations at any time from the user dashboard.

Users may request deletion of their entire account and all associated data by contacting support@izbaviz.com.

13. Liability

The Controller makes every effort to ensure the continuity and highest quality of services; however:

  • The Controller is not liable for service interruptions due to technical reasons, maintenance, or force majeure.
  • The Controller is not liable for consequences of using visualizations for purposes other than illustrative.
  • The Controller liability towards the user is limited to the value of services paid for by the user in the last 12 months.

14. Out-of-Court Dispute Resolution

Consumers have the option to use out-of-court complaint and redress mechanisms, including:

  • The European Commission Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
  • National consumer protection authorities in the consumer country of residence.
  • Mediation and arbitration bodies as provided by local consumer protection laws.

15. Final Provisions

These Terms of Service are governed by the laws of Poland. In matters not regulated herein, the provisions of the Polish Civil Code, the Consumer Rights Act, and the Act on Providing Services by Electronic Means shall apply.

The Controller reserves the right to amend these Terms of Service. Users will be notified of changes via the Service or by email at least 14 days before they take effect.

Changes to the Terms of Service do not affect orders placed before the effective date of the changes.

The current version of the Terms of Service is always available on the Service website.
